TERMS & CONDITIONS

FOR THE 18TH ANNUAL AIMIA AWARDS

Entries Close: 5pm AEST, Friday 21 October 2011, submitted via the AIMIA website.

1. Binding Terms
If you enter the awards, you are bound by these terms. By entering a product in the 18th Annual AIMIA Awards (the Awards), you are entering into an agreement with the Australian Interactive Media Industry Association ("AIMIA" or "we") on the terms set out below.

2. Eligible Products
You can only enter a product in the Awards if:

(a) the product is a digital media product or it contains significant digital elements;

(b) the product is stored on or served over (as the case may be) a cartridge, CD-ROM, DVD-ROM, intranet, extranet, the World Wide Web (the Web), iTV/Digital TV, PC or console, kiosk, or enhanced mobile networks;

(c) in the case of a product served over the Web, it is so served when you enter the product, when we judge it, and the section of the site you are entering was not served or has substantially changed since 1 July 2010;

(d) in the case of products not covered by paragraph (c), it is commercially available for sale or has been accepted and is being used by your client at the time you enter the awards, at the time we judge it and it was not available in its current format or so used prior to 1 July 2010; and

(e) the language used in the product is English or, if it is a multilingual product, there is a full version or translation of the product in English;

(f) you may NOT enter a product which is a prototype, an electronic proof of concept, or which has only been released in beta form. Products that are publicly/generally available and have had a prior alpha release are eligible for entry; (entrants into the Best Student Project Category are exempt from this clause)

(g) you may not enter a product, an earlier version of which was server, available or used (as the case may be) prior to 1 July 2010, unless the product you wish to enter is substantially and materially different from that earlier version;

(h) you may not enter a product which requires us to come to you or to a third party to judge it;

(k) if an entry requires proprietary hardware e.g. Wii, you must make arrangements for the required hardware to be available for the full judging period. In the event of an application such as iTV, AIMIA will co-ordinate with the entrant and the network provider to arrange time for judging. Applicants should ensure the network provider is able to accommodate the judging and should ensure the middleware is noted in their submission form.

3. Award Categories
There are 26 different Awards categories. You may enter a product in one or more of those categories apart from the following categories; Best of the Best, People's Choice, and Outstanding Contribution Award.

Best of the Best subject to the following rules:

(a) Where an entry uses a particular medium (for example, CD-ROM, or the Web), you must submit the entry using that medium;

(b) Where an award relates to a product-content type, your product falls within that type;

(c) It is the entrants responsibility to ensure entries are submitted to the correct category. AIMIA will not move your entry into another category if it does not comply with the above rules.

People's Choice subject to the following rules:

(a) Where an entry uses a particular medium (for example, CD-ROM, or the Web), you must submit the entry using that medium;

(b) Where an award relates to a product-content type, your product falls within that type;

(c) It is the entrants responsibility to ensure entries are submitted to the correct category. AIMIA will not move your entry into another category if it does not comply with the above rules.

Outstanding Contribution Award subject to the following rules:

Any AIMIA member in good standing (ie financial) may nominate any individual for this award - the recipient does not have to be an AIMIA member. Nominations must be accompanied by:

(a) a brief bio of the person being nominated;

(b) the details of their contribution to industry;

(c) the contact details of the nominee; and

(d) the contact details of the person making the nomination.

Nominations received without these details will not be considered.

Nominations will open on Friday 14th September 2011 and must be submitted via the AIMIA website, by 5pm AEST on Friday 21st October, 2011.

4. Entry Fees
You must pay the applicable entry fee in Australian dollars for each product that you enter in the Awards at the time you submit your entry. The entry fee must be paid for each category a product is entered into. Entrants must be AIMIA Student, Sole Trader, SME or Business members, however it is acceptable to join as a member in conjunction to entering the awards, in order to enter.

5. Submitting an Entry
You should submit the following information and material in relation to each product you are entering in the Awards at the time you enter:

(a) in the case of a product which comprises or includes a website, the URL for that site;

(b) in the case of a product that comprises or includes a Macintosh or Windows-compatible CD-ROM or DVD-ROM, SIX copies of that CD-ROM or DVD-ROM plus an additional SIX copies for each category in which you enter the product after the first unless otherwise uploaded to the entry site for the judges to download;

(c) special installation instructions, if appropriate;

(d) an original printed copy of your entry, identical to that which was submitted on-line, and signed by both the entrant and a Senior Executive or Manager must be received at AIMIA National Office along with SIX copies of entry materials (eg, DVD/CD Rom) by 5pm AEST Friday 4th November 2011. Where possible, please submit on re-writable format so that discs can be re-formatted and used for charitable purposes. Please also include your preferred navigation through the product to ensure particular features are highlighted.

Points to note:

* AIMIA will not accept entries in formats other than those set out in paragraphs (a) or (b),

* You will need to complete a separate entry form for each product,

* Entries that do not work will be excluded from the judging process; it is the entrants responsibility to ensure all criteria are met and the entry works as described.

6. Your Status
To enter a product in the Awards:

(a) you must be an Australian or New Zealand (NZ) resident natural person, fulltime student, company, partnership or trust, or an Australian state or territory, or an Australian or NZ federal government agency, or an Australian or NZ local government agency, or an Australian or NZ university, TAFE College or school; and

(b) you must be the developer and/or publisher of the product; and

(c) more than 75% by value of the development of the product must have occurred in Australia or New Zealand.

Points to note:

* You are taken to be the developer of a product if you directly supervised and managed the overall creative and technical design and development of the product, and you used your own skills and those of your staff or freelancers, even if you subcontracted some elements of the product.

* You are taken to be the publisher of a product if you distributed or made available the product to the public, and may have either internally developed the product or commissioned and/or collaborated with an independent developer. Where an entry involves an independent developer for a significant proportion of the production (over 25% by development effort (in hours or days), or responsible for key creative and technical contribution), the entry should provide credits to the independent developer.

* If two or more parties jointly developed the product, the entry should be in the joint names of the developers involved.

7. Exclusion of Entries
AIMIA may exclude your entry in certain circumstances
We may, at any time, exclude your entry from the Awards if
(a) you do not have a current AIMIA membership during the entry period, judging period and on the night of the awards ceremony
(b) your entry does not comply with Clause 2; or
(c) you have not paid the entry fees under Clause 4; or
(d) you did not, when entering the product, comply with Clause 5; or
(e) your status does not conform with Clause 6; or
(f) your entry was received after the closing date for awards entries, unless we extend the closing date.
You agree that AIMIA’s decision on this matter is final and may not be reviewed. You also agree to forfeit entry fees you have paid if your entry is excluded under this Clause.

8. The Judging Process
(a) All commercially sensitive data will be held in confidence and AIMIA Awards judges agree to a code of confidentiality prior to commencing judging.
(b) AIMIA will arrange for the judging of entries for each category of the Awards in accordance with judging rules developed by AIMIA. You agree that the decision of AIMIA and/or the Awards judges is final in all circumstances, and AIMIA will not be obliged to supply you with any information about the judging of your entry.
(c) We will judge your entries on the degree to which the entry exploits current digital technology to provide informative and/or entertaining content, through creative and combined use of audio, video, text, animation, images, graphics and navigation features of multimedia technologies.
(d) The Awards judges will select up to five finalists in each category. We will notify you if you have been selected as a finalist, and we will announce the names of the finalists for each category at the Awards presentation ceremony.
(e) If you are selected as a finalist, you agree to supply us with a video compile of highlights of your product for use at the Awards presentation ceremony if we ask you to do so.
(f) You agree that the property rights (other than the intellectual property rights) in a copy of the product or in a video compile of its highlights supplied to AIMIA under these terms pass to AIMIA on delivery to us.
(g) We have the right not to make an award in a category if we believe that the standard of entries in a category is not sufficiently high.
(h) The Judging Criteria for the 17th Annual AIMIA Awards are:
* Design innovation
* Fitness for purpose
* Visual impact and aesthetics
* Usability and Accessibility (specifically, Priority 1 of the World Wide Web Accessibility Guidelines)
* Technical expertise
* Special characteristics

Note: we will not return CD-ROMs, DVD-ROMs or other materials submitted. Where possible, please submit on re-writable format so that discs can be re-formated and used for charitable purposes.

9. Use Of Your Product
You license us to use your product in certain limited circumstances.

We will have the right to use the product you enter in the Awards in the following ways:

(a) showing excerpts of your product at the Awards presentation ceremony;

(b) using excerpts of your product to publicise and promote the Awards
